ORDINANCE No. 108 CONDUCT ON AIRPORT PROPERTY

METROPOLITAN AIRPORTS COMMISSION ORDINANCE NO. 108

An Ordinance to promote and conserve the public safety, health, peace, and welfare on properties owned by or under the supervision and control of the Metropolitan Airports Commission and establishing rules of conduct and regulating the activities of persons thereon by amending a specific provision of Ordinance No. 58.

WHEREAS, the Commission recognizes that it is in the public interest to allow dogs or other animals to exist unconfined in certain places, situations or instances upon properties owned by or under the supervision and control of the Commission; and

WHEREAS, by adopting this Ordinance the Metropolitan Airports Commission is making a minor amendment to Ordinance 58 without affecting substantial rights.

NOW THEREFORE, the Metropolitan Airports Commission does ordain:

SECTION 1 - DEFINITIONS

The definitions contained in MAC Ordinance No. 58 are applicable to this Ordinance.

SECTION 2 – AMENDMENT TO MAC ORDINANCE NO. 58

2.1 Section 7 of Ordinance No. 58 is amended to read:

Unless authorized by the Executive Director, no person shall bring any animal upon properties owned by or under the supervision and control of the Commission unless on a leash; no animal, except a seeing eye dog in custody of its master, or an animal properly confined for shipment, shall be permitted in buildings located thereon.

a. No person shall enter an aircraft observation deck or aircraft loading apron, ramp, or aircraft servicing area with a dog or other animal except a “seeing eye” dog, or one properly confined for shipment.

SECTION 3 - GENERAL PROVISIONS

  1. 4.1  Provisions Severable

    If any part of this Ordinance shall be held unconstitutional or invalid, this does not affect the validity of the remaining parts of this Ordinance. The Commission declares it would have passed the remaining parts of this Ordinance without the unenforceable provisions.

  2. 4.2  Penalty
    Any Person violating any of the provisions of this Ordinance shall upon conviction be

punished in accordance with the provisions of Ordinance 58.

4.3 Ratification

Unless specifically amended or supplemented by the provisions of this Ordinance, the provisions of MAC Ordinance No. 58 shall remain in full force and effect and are hereby ratified.

4.4 Effective Date

This Ordinance as amended shall be in full force and take effect upon the filing of the same with proof of publication thereof with the Secretary of State or the State of Minnesota.
