Airport. Mumeapolis-St.PaulInternationalAirport,Wold-ChamberlainField,apubhcairportunderthe supervision, operation, directionandcontrol oftheMetropolitan Airports Commission, andlocatedinthe County ofHemiepin and State ofMinnesota.

Airport Director. TheCommission's administrative officerortheofficer'sdesigneein chargeofthe tenninalareasattheAirport,and,forpurposesofthelicensing,permittingandcontrolofTaxicabsand enforcemeutofthisOrdinance,theagentoftheMetropolitanAirportsCommission.

AirportProperty. AUpropertyownedbytheAirport.

AirportTaxicabSystem. A systemdesignedtofacilitatethetransportationofTaxicabpassengersfrom theAirport. Itincludes,butisnotlimitedto,alldesignatedTaxicabroadways,TaxicabHoldingAreas, TaxicabLoadingAreas,TaxicabStagingAreas,andanAutomaticVehicleIdentification(AVt) Systemor a similarvehicletrackingsystem.

AirportUseFee. ThefeesetbytheCommissionthatDriversareauthorizedtochargeinadditiontothe meteredfareinordertorecoveruptotheapproximate costpaidtofheCommission fortheTaxicabPermit andPer-Trip Fee.

AutomaticVehicleIdentification('AVB.S^tmi. A systemthatutihzesAVItags,readers,controllers,

gates,loops,signs,andcomputerstodispatch,monitor, andcontrolPermittedTaxicabswithmtheAirport Taxicab System.

AVITag. A smalldevicethatcontrolsVehicleaccessandsignalswhenVehiclesenterorexitthe Commercial Lanes.

Commercial Lanes. TrafficlanesdesignatedbytheAirportDirectorasPermittedTaxicabLanesorareas

forusebyPre-Arranged Taxicabs.

Commission. TheMetropolitanAirportsConumssion,apubliccorporationorganizedandoperating pursuanttoChapter500,LawsofMumesota 1943andamendmentsthereto.

Commumcation Device;Commumcation Deviceshallincludeoneormoreofthefollowingoptions;live radiodispatching,operationalcellularphone,orotherequipmentasapprovedbytheAirportDirector.

CompanyRepresentative. Anyoneemployedby,AffiliatedWith,oractingonbehalfofa Service Companyandrepresentingitsinterests,including,butnotlimitedto,Drivers.

Driver. EverypersonwhodrivesorisinactualphysicalcontrolofaTaxicabunderthisOrdinance.

DwellFee. A feeimposedonPre-ArrangedTaxicabsnotpermittedbytheCommissionforexceedingthe prescribedtimein pickinguppassengerswlule operatingintheCommercial Lanes.

Executive Directo^CEQ. The Commission's chiefexecutive ofBcer or a designated representative.

HearineOfficer. A designeeoftheExecutiveDirector/CEO whoshallconducthearings,hearevidence andmake a determination regarding fines. Suspension and/orRevocation ofService Company Authorizations, TaxicabPennits, andMAC Drivers' Licenses.

MAC. TheMetropolitanAirportsCommission.

MACDriversLicense. Thedriver'slicensethatauthorizesDriverstopickuppassengersattheAirport throughthePermittedTaxicabLanes.ThislicenseiscreatedandstoredinMAC'Sdigitaldatabaseandnot physically issued to the Driver.

MACRepresentative. AnyPersonauthorizedbytheAirportDirectortodirectorcoordinateTaxicab operationsattheAirport,includingMACLandsideStaffandemployeesoftheAirportPolice Dqiartment.

Owner. ThePersonwhoholdsthetitletoaTaxicabVehicle.
Penmtted Taxicab. A Taxicab for which an Owner has a Taxicab Permit.

Permitted Taxicab Lanes. The Commercial Lanes at the Terminal 1-Lindbergh andthe Terminal 2- HumphreythatTaxicabspermittedunderthisOrdinancemustusetopickupnon-prearrangedpassengers.

Person. Any natural person, firm, partnership, association, corporation or other entity.

Pre-Arraneed Taxicab. A Taxicab that is at the Airport to pick up passengers for a pre-arranged trip, and thatusestheCommercial LanesdesignatedforPre-ArrangedTaxicaboperation.

Revenue Card. A cardthat allows MAC to chargetheDriver's account anyapplicable Per-Trip Feein accordance with this Ordinance.

Revocation. ThediscontmuanceofaServiceCompanyAuthorization,aMACTaxicabPamit,oraMAC Driver's License.

ServiceAnimal. Anyguidedog,signaldog,orotheranimalindividuallytrainedtodoworkorperform tasksforthebenefitofanindividualwithadisability,including,butnotliimtedtoguidingindividuals withimpairedvision,alertingindividualswithimpairedhearingtointmdersorsounds,providingminimal protection or rescue work, pulling a wheelchair, or retrieving dropped items.

Service Company. A company that conducts Taxicab business activities and has Taxicabs Affiliated With it operating at fhe Airport.

Service Company Authorization. An authorization from the Aiiport Director issued to a Service Companythatallowsthe ServiceCompanyto conductbusinessactivities andto operateTaxicabsatthe Airport.

Suspension. Thetemporarydiscontinuanceofa ServiceCompany'sAuthorization,a TaxicabPermitor a MAC Driver'sLicense.

Taxicab. AnymotorVehiclecanyingpassengersforpayorhiretospecificdestinationsrequestedby passengersuponpublicstreetsanduponthestreets,avenuesandroadsoftheAirport, andsubjecttocall onoruponsuchpublicstreetsandAirportstreets,avenuesorroadsorfromagarageorotherestablished placeofbusiness,notincludingTransportationNetworkCompaniesasdefinedbyMinnesotaStatute § 65B.472,orasamended.

TaxicabHoldmsArea. AnyareasdesignatedbytheAirportDirectorforTaxicabstoremainwhile activelyregisteredintheAVIorvehicletrackingsystem.

TaxicabLoadineArea. AnyareasdesignatedbytheAirportDirectorforTaxicabstoloadpassengers.

TaxicabManual. A manualestablishedbytheAirportDirectorthatsetsforthrequirementsforthe operation ofTaxicabs.

TaxicabPermit. AnauthorizationfromtheAirportDirectortoa TaxicabOwnerthatallowstheTaxicab topickuppassengersattheAirportthroughthePemiittedTaxicabLanes. AnOwnerwhocomplieswith therequirements ofthisOrdinancemayregisteronevehicleperTaxicabPermit.Thispermitiscreated and stored in MAC'S digital database and not physically issued to the Owner.

TaxicabStagineArea. AnareadesignatedbytheAirportDirectorforTaxicabstotemporarilyremain whileactivelyregisteredintheAVIorvehicletrackingsystem.

TaxicabStarter. AMACRepresentative whoisresponsibleforthefacilitationofpassengertransportation at the Airport.

TaxicabMeter. AnymstrumeutordeviceattachedtoaVehicleanddesignedtomeasuremechanicallyor electronically thedistancetraveledbysuchVeMcle,torecordthetimetheVehicletravelsoriswaiting, andtomdicateuponsuchrecord,byfigureordesign,thefaretobecharged.

Vehicle. Everydevicein,uponorbywhichanyPersonorproperty isormaybetransported ordrawn uponpublic streetsandupon streets, avenuesandroadswithintheAirport.

ThisOrdinanceappUesto all ServiceCompanies,Persons,andVehiclesengagedinTaxicabtransportationatthe Airport.

Service Companies are authorized, Taxicab Vehicles are permitted, and Drivers are licensed by the Commission to serve fhe Airport and the traveling public. The Commission does not employ, subsidize or guarantee the profitability of Service Companies, Taxicab Owners, or Drivers.

SECTION 3 - ALTTHOMTY TO OPERATE

  1. 3.1  Service Company Authorization

    No Service Company shall operate, and no Taxicabs Affiliated With the Service Company, except Pre- Arranged Taxicabs, shall pick up passengers within the Airport Taxicab System without a current valid Commission authorization.

  2. 3.2  Taxicab Permit

    AllTaxicabs,exceptPre-ArrangedTaxicabs,musthaveavalidannualMACTaxicabPermit,andhavean AVITagorotherdevice approved by(heAirport Director inordertopickuppassengers attheAiiport.

  3. 3.3  MAC Driver's License

    No Driver shaU operate, and no Service Company shall aUow a Driver who is Affiliated With it to operate, a Taxicab pemiitted under this Ordmance at the Airport without a current, valid MAC Driver's License.

  4. 3.4  Hish Volume Events

    The Airport Director may declare a High Volume Event at the Airport. Such event may be declared when conditions exist that are likely to create a need for Taxicabs at the Airport that is greater than can be met bytheexistingnumberofPermittedTaxicabsorServiceCompanies.DuringsuchaHighVolumeEvent, theAirportDirectormayauthorizenonPennittedTaxicabstooperateattheAirportsubjecttotenns, times, conditions, and fees as determined by the Airport Director.

SECTION4- SERVICECOMPANIES

SECTION 2-SCOPE

4. 1

Authority to Operate

  1. Upon application, the Airport Director may issue an anniial, non-transferable Authorization to a Service Company to conduct Taxicab business activities and to operate Taxicabs in the Airport Taxicab System.

  2. A Service Company Authorization shall apply for one year fiom the date the Authorization is granted, or as otherwise established by fhe Commission, and must be renewed annually.

  3. An annual Service Company Authorization will not be issued to a Service Company that has past duefees,fines,orisindebtedtotheCommissionatthetimeofapplication. Inaddition,the

AirportDirectormaydenyrequestsforServiceCompanyAuthorizations wheretheinterestsof thetravelingpublicaad/ortheefficientoperationoftheAirportarebestservedbysuchdenial.

d. The Service Company shall bepenalized for the operation within the Airport Taxicab System of a non-permittedTaxicabthatisAfffliatedWithit. TheServiceCompanyshallbepenalizedforthe operation by anunlicensed Driver within the Airport Taxicab System ofaTaxicab that is AfBUatedWithit.

4.2 Service Comoanv Requirements

A ServiceCompanymaybeauthorizedbytheCommission whentherequirements setforthm thisSection aremet. All ServiceCompanies shallmaintaintheserequirements throughout theyearforwhichtheyare authorized.

  1. Distinct Name and Loeo. and Secretary of State Reeistration

    EachServiceCompanyshallhaveadistinctnameandlogo,andshallberegisteredwiththe Office oftheMinnesota Secretary ofState.

  2. Directory Assistance Reeistration

    TheServiceCompanynameandtelephonenumbermustberegisteredwithDirectory Assistance for Minneapolis or St. Paul.

  3. Central Place ofBusiness

    EveryServiceCompanyshallmaintainanof&ce,witharegisteredaddress(noP.O.Box)and withregularbusinesshours,withinthirty(30)milesoftheAirport. Regularbusinesshours shouldmatchMAC LandsideOperations' ofBcialbusinesshours.

  4. Record Maintenance

    EachServiceCompanyshallmaintainthefoUowingrecords,atthecentralplaceofbusinessas defmedin4.2(c),foraperiodofatleastthree(3)years:

    (1) CurrentinformationoneachTaxicabOwnerAffiliatedWiththeServiceCompany,as required under Section 5. 5;

    1. (2)  Current information on eachDriver Affiliated With the Service Company, including, but not limited to the Driver's residence address and telephone number, fhe Driver s application history, andcustomer complaints againsttheDriver andresolution records of those complaints;

    2. (3)  Themodel,make,year,licensenumber,vehicleidentificationnumber,TaxicabPemiit numberandTaxicabmanual-compliance andmechanicalinspectionrecordsobtained pursuanttoSection5.2(f)foreachTaxicabAffiliatedWiththeServiceCompany;

    3. (4)  Currentinsurancemformation foreachTaxicabAffiliatedWiththeServiceCompany;

  1. (5)  Trip sheetsthatmeettherequirements setforthintheTaxicabManualforeachPemiitted TaxicabandDriverAffiliatedWiththeServiceCompany,andthatarecollectedbythe ServiceCompanyonamonthlybasis,nolaterthanthetenth(10th)ofeachmonth;and

  2. (6)  InformationonwhichPennittedTaxicabsandDriversareoperatingoneachdayor portionofaday,sothattheServiceCompanyisabletoinfomiaMACRepresentative as towhichDriverisorhasbeendrivingaVehicleAffiliatedWiththeServiceCompany.

Record InsDection

EveryServiceCompanyshallcomply,bytheendoftheseventh(7 ) businessday,with a reasonablerequestbyaMACRepreseutative toinspecttherecordsmaintainedbytheService CompanyasrequiredinthisOrdinance.AMACRepresentative maychoosetoconductthe RecordInspectionattheServiceCompany'sCentralPlaceofBusinessor attheAirport.

Communication Device

ServiceCompanies shallmaintaincommunication atalltimeswithallDriversandTaxicabs AffiliatedWiththeServiceCompanythroughaCommunication DevicewhileTaxicabs Affiliated Withthe Service Company arein operation.

Service Company Representative

EveryServiceCompanyshallhaveoneRepresentative orDesigneethatisthesolecontactforthe ServiceCompanym anycommunicationnecessarybetweentheCommissionandtheService Company during regular business hours.

Information Reouests

Every Service Company shall provide information in response to a reasonable request from a MAC Representative within sixty (60) minutes duringnormal businesshours. Suchinformation

includes,butisnotlimitedto.Drivermformation,Vehicleinformation,andtrip sheet infonnation.

FRemovedl. Vouchers

EveiyServiceCompanyshallensureeveryDriveroperatinga TaxicabAffiliatedWiththe ServiceCompany, acceptsairlinevouchersaspaymentfortheTaxicabfare,ifsodirectedbythe Airport Director. Each Service Company shaU establish vendor accounts under the Service Companys nameandcontactinformationwithallairlinesservingtheAirportandshallprocess vouchersforonlyOwnersandDriversAffiliatedWiththeirServiceCompany. Service Companies shall reimburse Drivers Affiliated With the Service Company fhe full facevalue of thevoucherina reasonabletimeframe.MACshallcommunicatetotheairlinestheimportanceof timely payment ofairline vouchers.

HandlineofCustomer Comulaints EveryServiceCompanyshallproperlyandthoroughlyhandleallcustomercomplaints:

  1. (1)  Intheeventthata MACRepreseutativereceivesa customercomplaint,thatcomplaint will beforwardedto the ServiceCompanyandthe ServiceCompanymustinvestigatethe complaint. UponreceipttheServiceCompanymustinformtheMACRepresentative of thestatusofmyforwardedcomplaints bytheendofthenextbusinessday.TheService CompanymustinfonnMACoftheultimateresolutionofthecustomercomplaint.

  2. (2)  TheServiceCompanymayconsulttheAirportDirectorforassistancewheuappropriate.

Insurance

EveryServiceCompanyshallensurethateachTaxicabAffiUatedWithfheServiceCompany meets(heinsurancerequirements ofSection5.4.TheServiceCompanymustnotallowany uninsuredTaxicabtooperateattheAirport.TheServiceCompanywUlberesponsibletothe Commission fortheoperation ofmyuninsuredTaxicab, andwillberesponsible forany applicableprocessingand/orreactivation feespursuanttoScheduleI.

Information onFile

  1. (1)  EveryServiceCompanyshallnotifytheCommissioninwritingofallMACPennitted TaxicabsthatareAffiliatedWiththeServiceCompany.

  2. (2)  EveryServiceCompanyshaUprovidetheCommissionwrittennoticeofmyTaxicabs newlyAffiliatedWiththeServiceCompany, andofanyTaxicabsnolongerAffiUated WiththeServiceCompany,bytheendofthenextbusinessdayfollowingthechangeof affiliation.

  3. (3)  EveryServiceCompanyshallkeepthecurrentServiceCompanyrepresentative(s) and ServiceCompany owner(s) nameonfilewiththeCommission atalltimes.

Wheelchair Accessible Vehicles

ServiceCompameswithten(10)ormorePemiittedTaxicabsattheAirportmusthaveleastone Permitted Taxicab that is a wheelchaii accessible Taxicab and is available to pick up passengers

4.3

at the Airport. Annual Review

  1. Every Service Company shallbe subject to a reasonable annual review conducted byMAC Representatives todetemiinewhethertheServiceCompanyismeetingtherequirements ofttus Section.Theannualreviewshallbeconductedatleastthirty(30)dayspriortotheService

    Company Authorization renewal date.

  2. TheannualreviewmayincludeameetingbetweenMACRepresentatives andtheService Company Representative.

c. ShouldServiceCompanyrecordsnotbecomplete,properlyonfileinanorderlyfashion,and available for review by MAC Representatives atthe time ofthe annual Service Company review, a re-inspection fee as set forth in Schedule I, or as otherwise modified by the Airport Director, may be charged for each additional iuspection required to complete the Review.

SECTION5- TAXICABPERMITS

5. 1

5.2

Annual Permit AnannualTaxicabPermitshallapplyfortheperiodasestablishedbytheCommission. Taxicab Peimit ReauJTements

Uponapplication,theAirportDirectormayauthorizeanannualTaxicabPemiittotheOwnerofa Taxicab whentherequirementssetforthinthisSectionaremetandwheretheinterestsofthetravelingpublicand theefBcient operation oftheAirport arebestservedbysuchissuance.

TheAiiportDirectormaydenyrequestsforTaxicabPermitswheretheinterestsofthetravelingpublic andtheefEcientoperationoftheAirportarebestservedbysuchdenial.TheCommissionmaydirectthe AirportDirectortolimitthenumberofTaxicabPemiitsinordertopromotetheefBcientoperationofthe Commission'sgroundtransportation systemandtopromoteorderlytrafficflow,inaccordancewith applicableMimiesotaStatutes.All OwnersshallmamtaiatheseTaxicabPermitrequirementsthroughout the annual Penuit time period.

  1. ServiceCompany

    The Taxicab Owner must be a Service Company, or must be Affiliated With a Service Company, thatmeetstherequiremaits ofthisOrdinance.

  2. Title
    The Taxicab Owner must hold legal title to the Vehicle as evidenced by the certificate oftitle.

  3. Insurance
    The Taxicab Owner must provide proof ofinsurance asrequired by Section 5.4.

  4. Age ofVehicle

    Foreachpermittingyear,taketheyearinwhichthepermittingperiodbeginsandsubtractten (10) to calculate the oldest model year eligible for permitting.

    Thismeanseleven(11)modelyearswillbeeligibleforpenmttingeachyear.Forexample,the modelyearseligibleforpemutting in2017wiUbe2017, 2016,2015, 2014, 2013, 2012, 2011, 2010, 2009, 2008and2007.

    TheAirport DirectormayextendthevehicleageforcertainwheelchairaccessibleTaxicabsat his/her discretion to incentivize more wheelchair accessible Taxicabs to operate at the Airport.

5.3

  1. Vehicle Minimum Size Standards AllTaxicabsmustcomplywithfheminimumsizestandardssetforthintheTaxicabManual.

  2. Taxicab Manual Compliauce and Mecliamcal Inspection

    TheTaxicabVehiclemustpassaninspection, attheOwner'sexpense,pursuantto standardsset forth m the Taxicab Manual at a facility designated or approved by the Airport Director. The AirportDirectorwillissueataxicabinspectionformtobeusedintheinspectionoftaxicabs.

  3. TaxicabMeter Calibration Certificate

    For mechanical Taxicab Meters, the Taxicab Owner must furnish a current Taxicab Meter calibrationcertificateatthetimeoffhemechanicalinspectiondescribedinSection5.2(f)and a copyofsuchcalibrationcertificate shallbekeptin(heTaxicabatalltimesandshownatthe request ofa MAC Representative.

  4. NoPastDueAmounts

    A Taxicab Penmt will not be authorized to an Owner who has past due fees, fines or is indebted totheCommission atthetime ofapplication.

AVITae

  1. Commission Property

    AnAV[TagprovidedtoaTaxicabOwnerremainsthepropertyoftheCommission.TheAVITag shall at all times be affixed in a location that is designated by the Aiiport Director and that allows the tag to operate properly.

  2. No Unauthorized Transfer AnAVITagshallonlybeusedintheTaxicabforwhichitisauthorized.

Insurance and Indemnification
a. Commercial Automobile Liability Insurance

The Owner shall have commercial automobile liability insurance for each Vehicle in force at all timeswithmimmumcoveragelimitsofeither(i)$200,000bodilyinjuryperperson,$600,000 bodilyinjuryperaccident,and$200,000propertydamage;or(ii)acombinedsinglelimitof $1,000,000foreachoccurreuce. Theinsurancepolicy shallnametheMetropolitanAirports Commission as an additional insured. The Owner must have a completed msmance certificate evidencingsuchcoverageonfilewiththeCommission atalltunes.Themsuraiicecertificate shall besubmittedontheformasrequiredbytheAirport Director.

InsurancemustbeprovidedbyacompanylicensedtowritesuchinsuranceintheStateof Minnesota.Also,liabilitymustnotbelimitedduetoinsolvencyorbankruptcyoftheinsured.The

Commissionmustimmediatelybenotifiedinwritingthata Vehicle(s) isbeingdeletedfromthe policy. The Coimnission must benotified in writing ten (10) daysbefore a policy maybe canceledorchangedbyendorsement. TheOwnerwillbeheldresponsibleifpropernoticeisnot providedbyfheinsurancecompany.Also,coveragemustnotbelimitedinanywaywheninsured Vehiclesaredriveu,used,operatedormaintainedwhiletheDriveroroccupantsareunderthe influence ofalcohol orcontrolled substances, orengagedintheUlicitto-ansportation ofsuch

substances. Indemmfication

TheOwnershallindemnifyandholdharmlesstheCommissionforthenegligent actsofthe OwnerorDriverwithpermission, expressedorimplied, oftheOwnerofallcoveredVehicles resultinginpersonal injury orproperty damagewithintheliimts ofcoveragestatedherein.

Owner Information on File

  1. Owner Information

    EachTaxicabOwnershallkeepa currentaddressandteleplionenumberonfilewiththe ServiceCompanyand(heCommissionatall times.

  2. Chanees

MAC Driver's License

MAC Driver's Licenses shall be effective from the date of issuance until one (1) year following the date of effectivenessorasmodifiedbytheAirportDirector.TheAiiportDirectormaylimitthenumberofMAC Driver'sLicensesinordertoservethepublic'swelfareandprovidefortheefGcieutoperationofthe Airport. To be licensed, an applicant must submit to MAC the MAC Driver's License application, including providing all information required on the application, and pay the MAC Driver's License fee as described in Section 11. 6.

MAC Driver's License Requirements

Upon application, the Airport Director may authorize a nontransferable MAC Driver's License to a Person whomeetsthefollowingrequirements. All licensedDrivers shallmaintaintheselicensequalifications throughout thetermoftheirMACDriver'sLicense.

  1. Identification andAuolication Requirements

    For an initial MAC Driver's License, fhe applicant must appear in person before a MAC Representative andpreseutavaliddriver'slicenseissuedbyastateorterritoryoftheUnited StatesofAmericaandcompletetheMACDriver'sLicenseapplication,includingallinformation required on the application, which includes infonnation required under Minnesota Statutes § 270C. 72.

  2. National Criminal Background Check and Drivine Record Check

    Applicants must undergo a national criminal background check and driving record check through athirdpartybackgroundcheckcompany/provider approvedbytheAirportDirectorhiredeither throughtheapplicant's ServiceCompanyorthroughMAC,providedthatanapplicantwhoisalso anownerofa ServiceCompanycaimotperfonnthenationalcriminalbackgroundcheckand drivingrecordonthemselves. Thenationalcrimmalbackgroundcheckshallcoveraperiodofno lessthantheprevious ten(10)years(unless statelawprescribes a shorterperiod) andthedriving recordcheckshallcoveraperiodofnolessthantheprevious five(5)yearsandmustincludeall statesmwhichapplicanthasheldadriver'slicenseforpreviousfive(5)years.TheAirport Directormayadoptadditionalrequirements forthenationalcriminalbackgroundcheckand driving record check.

    IfthenationalcriminalbackgroundcheckanddrivingrecordcheckisdonethroughMAC,the applicant shall submit the necessary information andtheir informed consent to MAC sothat the nationalcriminalbackgroundcheckanddrivingrecordcheckcanbeperformed. IfMAC performs the national crimmal background check and driving record check, a background check feewillbeassessedandmustbepaidbyeithertheapplicantortheapplicant'sService Companybeforea MACDriver'sLicensewillbeauthorized.ThisfeeissetforthinSchedule I orasotherwisemodifiedbytheAirportDirector.

    IfthenationalcriminalbackgroundcheckanddrivingrecordcheckisdonethroughtheService Company, the Service Company must certify to MAC that the national criminal background

checkanddrivingrecordcheckhasbeenperformed accordmgthecriteria above, andthatthe applicantmeetstherequirementsoutlinedm Section6.2(c).TheServiceCompanymustkeep recordsoftheiiationalcriminalbackgroundcheckanddrivingrecordcheckfora periodofthree (3)yearsandshallallowsuchrecordstobereviewedbylawenforcementpersomieland a MAC Representative upon request.

One (1) year after the initial date of a MAC Driver's License, and annually thereafter, either the Service Company or MAC shall verity that the Driver is still eligible for a MAC Driver's License by perfbrmmg the national criminal background check and driving record check as outlined in this section (including paying MAC any applicable background check fee).

c. MAC Driver'sLicenseReauirements
No MAC Driver's License shall be authorized unless the applicant or Driver:

  1. Has no felony convictions in the last five (5)years;

  2. Has no non-traffic gross misdemeanor or misdemeanor convictions in the last three (3) yearsinvolving theuseorthreatofuseofforce,possession orsaleofacontrolled substance, prostitution, or indecent exposure;

  3. Hasatleasttwelve(12)monthsfromthedateofreleasefromimprisomnentfora sex crimeorcrimeofviolence. "Sexcrime"isanyprohibitedactthathasanelementof a sexualnature. "Crimeofviolence"meansanyprohibitedactthathasasanelement(a) the use or threat of force or a dangerous weapon or (b) a person (i) committing
    substantial bodily harm to another, or (ii) committing great bodily harm to another or (iii) causing(hedeathofanother;

  4. Has no convictions in the last five (5) years for any ofthe following offenses involving injuryordeathandnoconvictionsinthelastthree(3)yearsforanyoffhefollowing offensesnotinvolving injuryordeath:Hitandrun;drivingunderfheinfluenceofan alcoholic beverage or controlled substance; reckless or careless driving; or failure to submit to an implied consent test;

  5. Has no convictions in the last ten (10) years for Murder (Mum. Stat. §§ 609. 185 to 609.195),manslaughter(§§609.20to609.205),criminalvehicularhomicideand injury(§609.21),assaultI-IH(§§609.221to609.223),criminalsexualconduct(§§ 609. 342 to 609. 3451), indecent exposure (§ 617. 23, subd. 2 or 3); any violation of the controlled substance law (§152 et al) which is punishable by a maximum sentence of fifteen (15) years or more; as allowed under Mimi. Stat. § 364. 09, or violence at international airports (18 U. S. Code §37). No convictions in the last ten (10)yearsforanysimilarfelonycommittedinanotherstateorcountry;and

  6. Hasnoactivefelonycriminalwantsorwarrantsissuedforsuchperson.

TheapplicantorDrivermusthavea drivingrecordmeetingthefollowingstandards:

1. For original endorsement: No more than three (3) moving violations within the last three(3)years,mdnomorethantwo(2)movingviolationsinthelastyear.

  2. Drivine Experience

    Applicant shall have at least twelve (12) consecutive month's driving experience in the United Statesasa licenseddriver.Suchpriordrivingexperiencemaybeverifiedbya drivingrecord checkconductedbyMACortheapplicant's ServiceCompany.

  3. Age Theapplicantmustbeatleasteighteen(18)yearsofage.

  4. Driver SafetyandCustomer Service Tramine

    Theapplicantmusthavea demonstratedabilitytoread,writeandspeaktheEnglishlanguage.In addition,theapplicantmusthavea demonstratedknowledgeofthegeographyandstreetsystems oftheseven-countymetropohtan area,aswellasthelocationofmajorattractionswithinthose areas.Theapplicantmustalsohavea demonstratedknowledgeoftheprovisionsofthis OrdinancerelatingtotheconductofDriversandtheoperationofaTaxicab. TheAirportDirector may approve accredited facilities whichmayverify these abilities andthis knowledge.

    EachDrivershallobtaina certificateofcompletioninsucha coursedesignedtoimprovepublic serviceto TaxicabpassengersassoapprovedandwhendirectedbytheAirportDirector, and fromafacilitythatisaccreditedandapprovedbytheAirportDirector. Suchcoursesshallbe administered m compliance with the Americans With Disabilities Act. The certificate of completionmustbeprovidedtotheCommissionpriortoauthorizationofaMACDriver's License.Thecostoffhecourseshallbepaidbytheapplicant.

    ApplicantsshaUattendthecoursewhenspaceisavailableandobtaina certificateofcompletion (i) priortoapplyingfortheirimtialMACDriver'sLicense;(ii) iftheDriverreceivesthree(3) customercomplaintsinatwelve(12)monthperiod;(iii)inconjunctionwithpenaltiesestablished inScheduleIIwhereappropriate; and(iv)pursuanttoanypolicyadoptedbytheAirportDirector andincorporated intofheTaxicabManual. Failuretoobtaina certificate ofcompletion willresult in denial oflicense application and/or loss oftheMAC Driver's License, andloss ofdriving privileges.

  5. No Past Due Balance

    A MACDriver'sLicensewillnotbeauthorizedtoanyPersonwhohaspastduefees,finesoris indebted to the Commission.

To renew a MAC Driver's License, the Driver must meet all the requirements of Section 6.2 except6.2(g),providedthattheAirportDirectormayadoptrenewalproceduresthatallowthe identificationanddocumentation requirements outlinedinSection6.1(a)tobesubmittedto MAC electronically or through US Mail, rather fhan in person. Lost or Stolen Revenue Card

A lost or stolen Revenue Card shall be immediately reported to the MAC Landside Office. The appUcable feesmustbepaidto replacetheRevenueCard.

Thefeetoreplacea lostorstolenRevenueCard,ortocreatea duphcateRevenueCardforanyother purposeissetforthinScheduleI orasotherwisemodifiedbytheAirportDirector.

A Drivermayrefuseservicetoapassengeroriyifthepassengeris(a)sigmficantly impairedby orundertheinfluenceofanymtoxicatingliquororanydmg,or(b)posesa threattothephysical safetyoftheDriver.Insuchinstance,theDrivermustbringthesituationtotheattentionofthe Taxicab StarterondutyandexplainthereasonstheDriverbelieves thatthepassenger isimpaired, intoxicated,ora threattotheDriver'ssafety.Intheeventthata TaxicabStarterisnotonduty,the DrivershallcalltheAirportPoUceforassistance.

c. Penalty for Refusal

Thepenaltyforviolation ofSection7.4(a)willbeanImmediate Dismissal fromthePemiitted TaxicabLanes,pursuanttoSection12.2andthepenaltycalledform ScheduleIIorasamended.

d. Unlawful Discrimmation

UndernocircumstancesmayaDriverrefuseservicetoa passengerattheAirportonaccountof race, gender, religion, national origin, ethnicity, marital status, disability ofanypassenger who maybesafelytransportedintheTaxicab,statuswithregardtopublicassistance, sexual orientation, orage.Withoutlimitingtheforegoing,undernocircumstances willaDriverrefuse serviceto a passenger attheAirport solely onaccount ofthepassenger's beingaccompanied by Service Animal.

Commiinication Device

A DrivermusthaveanoperationalCoimnimicationDeviceturnedonwhileengagedinTaxicab transportation attheAirport.

Whilea customerispresentintheTaxicab,cellphonecallsmustbenolongerthanone(1)minute.An outgoingcallmaybemadeonlyifit aidsthecustomerpresent intheTaxicabortotheServiceCompany AffiUated With the Driver.

  1. All cellphoneuseattheTaxicabLoadingAreasisprohibited.

  2. All cellphoneusewhiletheTaxicabisinmotionmustbeconductedwithhands-freetechnology.

Lost Articles

TheDrivershallinspecttheVehicleafterthedeparture ofeachpassengertoascertainthatnoarticlehas beenleftbehind.IfapassengerleavesanarticleintheTaxicab,theDrivershallimmediately attemptto returnit.IftheDriverisunabletoreturnthearticle,theDrivershallimmediately notifytheService

Companydispatcher,describethearticletotheServiceCompanydispatcher,anddeliverthearticletothe PersonactingasTaxicabStarterassoonasreasonablypractical. Taxicabstarterswillprovideareceiptto anyDriverturningina lostarticle.

Permitted Taxicab Lane procedures, detailed operational procedures, andadministrative issues.ExceptforemergencydeclarationsbytheAirportDirector, theAirportDirectorshallpostnoticeseven(7) dayspriorto adoptingorchangingtheTaxicab Manualandholda meetmgatwhichproposedchangeswillbediscussed.

  2. Compliance with Manual

    EveryPersonandServiceCompanyengagedin TaxicabtransportationattheAirport shall comply with the Taricab Manual at all times.

Compliance with Laws and Orders

  1. Laws

    AllPersonsandVehiclesengagedinTaxicabtransportation attheAirportshallcomplywithall applicable federal, state andlocal laws, mcluding but not limited to anyapplicable ordinances or security directives.

  2. Orders

    AllPersonsengagedinTaxicabtransportation attheAirportshaUcomplywithalllawfulorders or directions given by MAC Representatives.

  3. Compliance Checks

    MAC Representatives may conduct random, unannounced compliance checks at any time to determine compliance with this Ordinance and the Taxicab Manual.

General Taxicab Operation

  1. Taxicaboperationandparkingshallatalltimesbeinaccordancewithrequirements established by fhe Airport Director.

c. No Taxicab Owner or Driver shall take any actions that threaten the safety, comfort or convenience ofpassengers or MAC Represeutatives or that mterfere with the efficiency of Airport operations.

Direct Route

Drivers must take the most direct route to the passenger's destination, unless the passenger expressly consents otherwise.

Items Displayed in Vehicle

Certain items as listed in the Taxicab Manual shall be displayed in fhe Taxicab at all times as described in the Taxicab Manual.

CrediVDebit Cards

Drivers shall_accept all major credit/detiit cards, including Visa and MasteiCard, as payment for the Taxicab fare and all credit/debit cards shall be processed with an electronic credit/debit card processmg system described below. If the electronic credit/debit card processing system in fhe Taricab is not fimctionmg ia accordance with these requirements the Driver may not operate such Taxicab at the Airport until the system is functioning properly.

Drivers must have an operational electronic credifdebit card processmg system that will allow the credit/debit card transaction to be processed in real time according to Payment Card Industry Data Security Standards. This electronic credit/debit card processing system must have the ability to provide an electronic or paper receipt to include the Service Company name, Service Company telephone number, Taxicab number, date, metered fare, and tip. This electronic credit/debit card processing system must includethenameoftheDriver's authorized ServiceCompany astheserviceprovider.

Vouchers

Drivers shall accept airline vouchers as payment for the Taxicab fare. SECTION8- TAXICABFAKES

Rate ofFare

  1. Meter Fare

    A Driver shall not charge more than the legal fare shown on the laxicab Meter, except as otherwise provided by this Ordinance. The legal rate of fare for fhe Taxicab Meter ("meter fare") maybesetbytheCommission. IntheeventthemeterfareisnotsetbytheCommission, themeter fare shall not exceed that authorized by the cities ofMinneapolis or St. Paul, whichever is greater. Members ofthe Taxicab industry may submit meter fare recommendations with accompanying writtenjustification totheTaxicab Advisory Committee byMay 15ofeachyear.

  2. Zone Fare
    The Airport Director may establish zone or destination fares, which include the Airport Use Fee,

for specific areas. If such fares are established, then the Driver shall not charge more than that fare. Zone fares shall be established at the time ofPemiit renewal.

c. RateofFareDisplayed

EachTaxicabshallhavefherateoffare,includmganymimmumrateoffare,displayedonthe outsideandinsideoftheVehicle,onbothsides,sothatitisclearlyvisibletopassengersupon entering the Taxicab.

  1. 8.2  Airport Use Fee

    One Airport Use Fee may be added to the meter fare for trips originating from the Airport. The amount of theAirportUseFeemaybeadjustedannuallybytheCommissiontorecoveruptotheapproximatecost paid to the Commission for the Taxicab Permit and Per-Trip Fee, based on the average annual number of tripsperTaxicabVehicle(roundedtothenearest$.25mcrementforeaseofcollection), fortheprevious yearexceptthatit shallnotbereducedbelow$2.00.TheDrivermayonlychargeoneAiiportUseFee regardless ofthe number ofpassengers or destinations.

  2. 8.3  Computation ofFares

    1. One Fare Per Trip

      Drivers may only cliarge one tare per 1axicab trip to the passenger or passengers they are transporting, whetherornotthepassengersaretravelingto thesamedestination, exceptinthe limitedcircumstancesofMACRepresentative-directedmultipleloading.A Taxicabtrip originatesfromfheAirport andconcludeswhenthelastpassengerhasbeendroppedoffatthe passenger's destination. One fare means the final rate on the Taxicab meter plus one Airport Use Fee,ortheZoneFareestablished.

    2. Multiple Loadine Exceotion

      MACRepresentative-directed multiple loadingoccursincircumstances suchasweather emergeucies, extremely heavy passenger trafGc, or when there is a limited number ofTaxicabs available.WhenMACRepresentative-directedmultiple loadingisutilized,anywaitingpassenger hastherighttorefusemultiple loading,maycoimnaiidtheTaxicab'simmediatedeparture, and shallnotbecausedunduedelay.IncasesofMACRepresentative-directed multiple loading, each passengerpaysthefallfare,butonlyoneAirportUseFeemaybechargedfortheTaxicabtrip. Nopassenger,however,shallberequiredtopayahigherfarethanifthatpassengerhadsoleuse oftheTaxicab.

  3. 8.4  Taxicab Meter

    Every Taxicab shall be equipped with a Taxicab Meter in good working order equipped to measure the rateoffarewhichmaylegallybecharged, andequipped soastoenablethepassengers ataUtimestosee thefareregistered.TheTaxicabMetershallbesoequippedthatitisnotcapableofalteringthelegalfare shownonthemeter.TheTaxicabMetermustbeoperatingatalltimeswhentheTaxicabisengaged.

    EachmechanicalTaxicabMetershallbeinspectedannuallybya meterrepairestablishment,acceptableto theCommission, whichwillcalibratethemetertotherateoffarewhichmaylegallybecharged.Written

documentationofthecalibrationshallbeprovidedatthetimeofthemechanicalinspection,pursuantto Section 5. 2(g). For electronic Taxicab Meters, the Airport Director may upon request, test such a meter to confinn its accuracy.

EveryDrivershallissueareceipttothePersonpayingfortheTaxicabtrip.Thereceiptshallincludethe date,thefinalfareamount,thenameoftheServiceCompanyforwhichtheDriveriscurrentlydriving, theServiceCompany'stelephonenumberthatisregisteredpursuantto Section4.2(b),andtheTaxicab number.

SECTION 9 - DMVER CONDUCT

Solicitation

WhileonAirportProperty,noPersonshallsolicitthebusinessofcarryingpassengersforhirein any Taxicab,andnoTaxicabshallbedrivenwithinthelimitsoftheAirport forthepurposeofsolicitingthe carryingofpassengersforhire.NoDrivershallprovideanypaymentto anyskycap,MACRepresentative, oranyotherPersonattheAirportinreturnforthereferralofpassengersorpreferautialtreatment.

"Solicitation"meanstodirectlyorindirectly,activelyorpassively, openlyorsubtly,ask,request,plead for,seek,ortrytoobtainpassengersforhireinaVehicle,whetherornotbytheOwnerorDriverofsuch Vehicle. This mcludes anyeffort byuseofvoice, movement ofbodyorbymechanical contrivance of whateversorttocallattentiontotheavailabilityofa Vehicletocanya passengerorbaggageforhire.The factthata Vehicledisplaysa mechanicaldevicetoindicatethatsuchVehicleisnotengagedisnot considered solicitation.

No Driver shall discriminate against anyPersonbasedon race, gender, religion, national origin, ethmcity, maritalstatus,disabilityofanypassengerwhomaybesafelytransportedinfheTaxicab,statuswithregard to public assistance, sexual orientation, or age.

Driver Behavior

a. A Drivershallatalltimesbecourteouswhendealingwithpassengers,thepublic,otherDrivers, or any MAC Representative.

b. ADrivershallnotuseprofaneorthreateninglanguageorgesturesdirectedatorinfrontofany passengers,thepublic, otherDrivers, oranyMAC Representative.

c. NoDrivershallinterfere withanyotherauthorizedDriverwithwhomanyPersonisnegotiating orinquiring aboutthetransportation ofPersons orproperty.

11. 1

ServiceCompanyAuthorizationFee.TaxicabPemiitFee. andPer-TripFee

Service Company Authorization Fee

  1. (1)  EachServiceCompanyshallpayanannual, non-refimdable ServiceCompany Authorization FeeassetforthinScheduleI orasotherwisemodifiedbytheAirport Director.TheServiceCompanyAuthorizationFeeshallbepaidinfiiUatthetimeof application.

  2. (2)  IftheServiceCompanywasissueda ServiceCompanyAuthorization intheimmediately precedingyear,theServiceCompanyshallpaytheannual,non-refundable, Service CompanyAuthorizationRenewalFeeinfullassetforthm ScheduleIorasotherwise modified by the Airport Director.

Taxicab Permit Fee

EachTaxicabOwnershallpayanon-refimdable TaxicabPermitFeeforeachTaxicabthatuses thePermittedTaxicabLanes.ThefeeforanannualTaxicabPermitshalleitherbepaidinfallat

thetimeofapplication orpaidinhalfatthetimeofapplicationplusPer-TripFeesasdescribed below.

Per-Trip Fee

A Per-Trip Fee shall be paid by the Driver with a credib'debit card, each time the Taxicab enters thePemiittedTaxicabLanesiftheTaxicabOwnerdidnotpaytheTaxicabPennitFeeinfall.

ThePer-TripFeewill beassessedforuseofthePennittedTaxicabLanes;thus,thecrediVdebit cardwillbechargedregardless ofwhethertheTaxicabtransports passengers.

TheAirportDirectormayestablishanincentiveprogramto encouragemorewheelchair accessibleTaxicabsto operateattheAirport. Thisincentiveprogrammayincludea reducedPer- Trip Fee.

Establishment orT axicab Permit Fee and Per-Trip Fees

TheTaxicabPermitFeeandPer-TripFeeshallbeestablishedbytheCommissionwhichrecovers a portionoftheTaxicabs'budgetedcostsfortheyear,andchargeforuseofthePermitted TaxicabLanes.WhendeterminingtheTaxicabs' shareoftheyear'sbudgetedcosts,the Commission shall take into consideration, among other things, actual historical costs, operational costs, admimstration, penalty feescollected, depreciation, andinterest attributable to theAirport temimal roadway system andthe commercial ground transportation and Taxicabs' facilities, and theprevious years'historical dataregardingthenumbers oftrips.

FortheyearbeginningJanuary1,2017,theTaxicabPeraiitFeeandPer-TripFeeshallbeas setforthinScheduleI.StartingJanuary1,2018,andeachyearthereafter,theTaxicabPennit Fee andthe Per-Trip Fee for the year shall be calculated by multiplying the previous year's

Taxicab Permit Fee and Per-Trip Fee by the index described herein. This index shall be the averageoftheaveragepercentagechangeoverthepreviousfive(5)calendaryears,not includingtheimmediatepreviousyear,of(1)theConsumerPriceIndex- AllUrban Consumers,MidwestRegion,orsimilarCPIindex,and(2)MAC'SOperatingBudgetExpenses aspublishedontheMACWebsite.TheCommissionmayraise,lower,orremovethisannual adjustment atapublicmeetingandnoticeofsuchmeetings shallbeprovidedinaccordance withSection13.2.TheFeesshallbepostedinaccordancewithSection13.2.TheTaxicab PemiitFeeamountsshallberoundedtothenearest$25.00mcremeat. ThePer-TripFeeamount shall be rounded to the nearest $0. 01 increment.

TheTaxicabPermit FeeandPer-Trip Fee, andfuture increases, maybe adjustedby the Commissionatpublicmeetingswithnoticeprovidedin accordancewithSection13.2.

Driver Safety and Customer Service Course Fee

IftheCommissiondecidestoprovideaDriverSafetyandCustomerServiceCourse,afeefortheCourse willbechargedsothattheCommissionrecoversthecostofprovidingthecourse.

Authorized Transfer Fee

The fee for an Authorized Transfer under Section 5. 7 shall be as set forth in Schedule I or as otherwise

modified by the Airport Director. One Service Company to Service Company Authorized Transfer per permit year will be allowed without a fee.

Insurance Processine Fee

An msuranceprocessingfee shallbechargedfor eachadministrative actiontakenwithrespectto the processing, handling, and/ortracking oftheinsurance foraPermitted Taxicab. Suchadministrative action includes, but is not limited to, receiving a cancellation notice, reinstatement notice, change of endorsementnotice,orchangeofcarriernotice.Thefirsttwo(2)incidentsofadmmistrativeactiontaken peryearwithrespecttoaPermittedTaricabwillbeexemptfi-omtheinsuranceprocessingfee.The amountoftheinsuranceprocessingfeeshallbesetforfhinScheduleIorasotherwisemodifiedbythe Airport Director.

Reactivation Fee

IfanAVITagis deactivated pursuant to Section 12.4(c) forthereasonin Section 12.4(a)(7), a reactivation feeshallbecharged, perindividual Penmtted Taricab, forreactivation oftheAVITag. Paymentofthereactivation feemustbepaidinfull, foreachindividualPermittedTaxicab,priortothe reactivation ofany affected AVI Tags. The amount ofthe reactivation fee shall be set forth in Schedule I or as otherwise modified by the Airport Director.

MAC Driver's License Fee

Theannual,nom-efimdable, feeforaDriver'sLicenseshallbesetforthinScheduleIorasotherwise modifiedbyfheAirportDirector.Thisfeemustbepaidatthetimeofapplicationorrenewalbyeitherthe Driver or the Driver's Service Company.

11.7 Fee Chanses and Other Fees

TheCommission hastheauthoritytoadjustanyofthefeesintMsSectionandinScheduleI andnotice shallbeprovidedin accordancewithSection13.2.TheAirportDirectorhastheauthorityto establish other fees that cover reasonable administrative costs for services provided to Taxicab Owners or Drivers.

SECTION 12- ENFORCEMENT

12. 1

Scope

  1. Violations

    Thesanctions setforthinthisSectionshallapplytoPersonscoimnittmg anyofthefollowing (hereinafter referred to as "violations"):

    1. (1)  ViolationsofthisOrdinance,theTaxicabManual,oranylawsorregulationsexpressly incorporatedby this Ordinance;

    2. (2)  ViolationsofanyOrdinanceoftheCommissionforwhicha criminalpeualtymaybe imposed;

    (3) ViolationswhileonAirportPropertyofanylawoftheStateofMinnesotaortheUnited States for which a criminal penalty may be imposed.

  2. Penalties

    PeualtiesforviolationsshallbeassetforthinthisOrdinanceandSchedulesIIandHI. The CommissionatpublicmeetingsmayreviewandchangeSchedulesIIandIIIasit deems necessary.Noticeshallbeprovidedasrequiredin Section13.2.

  3. Enforcement EnforcemeutofthisOrdinanceshallbedoneinauniformandnondiscriminatory maimer.

Immediate Dismissal From Permitted Taricab Lanes a. Conduct

MACRepresentativesmayimmediatelydismissfromthePermittedTaxicabLanesanyDriveror Vehicleonthegroundsthat,inthejudgmentoftheMACRepresentative:

  1. (1)  TheDriverortheOwneroftheVehicleis engagedinbehaviorinthePermittedTaxicab Lanes which amounts to a violation and/or which is disruptive ofthe efGcient operation ofthePermittedTaxicabLanes.

  2. (2)  TheDriverisdrivinga VehicleinthePemiittedTaxicabLaneswhichisinviolationof standardswhichrelatetotheabilityoftheVehicletosafelyconveypassengers.

  3. (3)  TheDriverhasviolatedPermittedTaxicabLanesprocedures orhastakenanimproper 29

  1. Other Actions Not Precluded

    Any Immediate Dismissal from the Pennitted Taxicab Lanes shall be without prejudice to other enforcement actions taken under this Section and Schedules II and III.

  2. Limitations On Immediate Dismissal

    Exceptasprovidedbelow,anImmediate Dismissal shallbeimposedforonetripthroughthe Penmtted Taxicab Lanes.

    Where the Immediate Dismissal is for the reason stated in Paragraph a(4) above, the Immediate Dismissal shall be imposed for one trip through the Pa-mitted Taxicab Lanes, or as set by the Commission.

    Subsequentviolationsofthetypecontainedina(l),(2),(3),(4),or(5)abovemayresultin subsequent Immediate Dismissals.

Delayed Suspension Repair Notice

  1. Conduct

    MACRepresentativesmayissuetotheServiceCompany,Driver,orOwnerofanyVehicle a Delayed Suspension Repair Notice upon observing that the Vehicle is in violation offhe Vehicle standardscontainedinthisOrdmanceortheTaxicabManual,butwhichdonotrelatetofhe ability ofthe Vehicle to safely convey passengers.

  2. Contents ofNotice
    The Delayed Suspension Repair Notice shall set forth:

    1. (1)  Thenatureoftheviolations);

    2. (2)  The date on which the violations) took place;

    3. (3)  Thedatebywhichtherepakofsuchviolation(s) musttakeplace("repairdate"),which shallbenolaterthanfourteen(14)calendardaysfromthedateoftheviolation;and

    4. (4)  Notice that the Taxicab Pennit for the Vehicle shall be suspended, and its AVl Tag deactivated, on the repair date without further notice, unless the Vehicle has passed inspection by a MAC Representative.

c. Duration

A SuspensionpursuanttoaDelayedSuspensionRepairNoticeshallbeforsuchtimeuntilthe Vehicle passes an inspection by a MAC Representative.

  1. Other Actions Not Precluded

    AnyDelayedSuspensionRepairNoticeshallbewithoutprejudiceto otherenforcement actions takenunderthisSectionandSchedulesIIandVI.

  2. Review

    AnyDelayedSuspensionRepairNoticeshallberenewablebytheAirportDirectoruponwritten request.

12.4 Immediate Suspensions a. Conduct

TheAirportDirector,ordesigneemayimmediatelysuspenda ServiceCompany'sAuthorization, a Taxicab Permit and/or a MAC Driver's License for the following reasons:

  1. (1)  FailurebyanOwnerto keepcurrenttheinfomiationrequiredby Sections5.2(c) and5.5, or a Driver to keep cuireut the information required by Section 6. 9.

  2. (2)  Failurebya ServiceCompanytorespondtotelephonecomnnmicationsbythe Commissionwithinsbcty(60)minutesifaTaxicabAffiliatedWiththeServiceCompany is onAirport PropertyorhasbeenonAirport Propertywithinthepastthirty (30)minutes, providedthattheCommissionhasattemptedto establishtelephonecontactbycallingthe ServiceCompany'sregisteredtelephonenumberor dispatchservice.

  3. (3)  FailurebyanOwnertorespondtotelephonecommunications bytheCommissionwithin sixty(60)minutesiftheOwnerisonAirportPropertyorhasbeenonAirportProperty withinthepastthirty(30)minutes,orotherwiseby 12:00p.m. ofthenextbusinessday, providedthattheCoimnissionhasattemptedto establishtelephonecontactbycallingthe Service Company through which fhe Owner is AfGliated With.

  4. (4)  Failurebya Driverto respondtotelephonecoimnunications bytheCommissionwithin tturty (30)minutesif theDriverisonAirportProperty,excludingtheLoaduigareas,or hasbeenonAiiportPropertywithinthepastsixty(60)minutes,orotherwiseby 12:00 p.m. ofthenextbusinessday,providedthattheCommissionhasattemptedto establish telephonecontactbycallingtheServiceCompany, OwnerortheDriveratfhephone number on file with the Commission.

  5. (5)  FailurebyaDrivertohavea CommumcationDeviceasrequiredbySection7.5.

  6. (6)  Failurebya ServiceCompany,OwnerorDrivertopayinfallanyoutstandingbalance foranyfeesorothermoniesthatarethirty(30)dayspastdueorfinesthatarenotpaid withinthetime specifiedbythe Ordinance.

  1. (7)  Failurebya TaxicabOwnertohavetheinsurance, asrequiredbySection5.4,infiill forceandeffectatanytimeduringthetermoftheTaxicabPermit.

  3. (9)  Violationswherethefailureto immediately suspendmayjeopardizethehealth, safetyor welfareofthetravelingpubUc,otherDrivers, orMAC Representatives.

  4. (10)  TheServiceCompanyhasnot suppliedthenecessaryoperational crediVdebitcard processing system to a Vehicle asrequired in Section 4.2(i).

b. Immediate Suspension Order

Upon fmding causefor suchImmediate Suspension, theAirport Director or desigaeeshall immediatelyissuea writtenOrderofImmediateSuspensiontotheServiceCompany,Owner,or Driverdependingonthenatureoftheviolation. TheImmediateSuspensionOrdershallstatethe groundsfortheSuspensionandinformfheServiceCompany, Owner,orDriverthatheorshe maypresentadditionalinformationtotheAirportDirector, ifheorshechoosestorequestthatthe Airport Directorvacatethatorder. If suchadditionalinformation ispresentedto theAuport Director,theAirportDirectorshallconsidersuchinformationandshallpromptlyaffirmorvacate the Order ofImmediate Suspension.

c. AVITaeDeactivation

UpontheissuanceofanOrderforImmediate Suspension, theCommission maydeactivatethe AVITagforoneormoreoftheTaxicabsAfEUatedWiththeServiceCompany. Wherethe ImmediateSuspensionisforDriverconductforfhereasonsstatedm Paragrapha(l) ora(4) above,(heCommissionmaydeactivatetheAVITagoftheVehiclewhichtheCommission reasonably believes the Driver is operating.

d. Immediate Suspension Duration

WheretheImmediateSuspensionisforthereasonsstatedinParagrapha(l), (2),(3),(4),(5),(6), (7), (8), or(10) above,theImmediate Suspension shallendandtheAVlTagshallbereactivated assoonaspractical (butnotlaterthantheendofthebusinessday)uponremediationofthe reasonsfortheImmediate Suspension. WheretheImmediate Suspensionis forthereasonsstated inParagrapha (9)above,theImmediateSuspensionshallbeforsuchtimeastheAirportDirector ordesigneedeterminesthat therecontinuestobeathreattothehealth,safetyandwelfareof fhe public, providedthatiftheImmediate Suspensionperiodshallexceedseven(7)daysafter issuanceoffheOrderofImmediateSuspension,theAirportDirectorshallinitiateproceedingsfor Suspension orRevocation through issuance ofanappropriate notice.

Administrative Fines a. Amount

AdministrativeFinesshallbeimposedforviolationsofthisOrdinanceandtheTaxicabManualas set forth in Schedules II and in.

    ServiceCompanyAuthorizations, TaxicabPermitsandMACDriver'sLicensesmaybe suspendedfor anyoneofthefollowmg reasons:

    1. (1)  Repeatedviolations forwhichfineshavebeenassessed, assetforfli in Schedules K and ffl;

    2. (2)  Violations for whichSuspensionis specifiedin ScheduleII; or

    3. (3)  Violations whichareaggravatedinnaturebytheiradverseunpactontheorderlydelivery ofgroundtransportation servicestothepublicortheefficientoperationoftheAirport.

  2. Notice of Suspension

    TheAirportDirectorshallhavetheauthoritytoissueaNoticeofSuspension. TheNoticeof Suspensionshall set forth:

    1. (1)  thenatureoftheviolations)whichisthereasonfortheSuspension;

    2. (2)  thedateoftheviolations);

    3. (3)  thelengthofthe Suspension;

    4. (4)  the date on which the Suspension shall commence;

The Airport Director shall review any report brought to his or her attention and may conduct additional investigation into such facts as deemed necessary m order to determine whether there are grounds for issuance of a Notice of Suspension. A Suspension shall commence not earlier than twenty-one (21) calendar days from the issuance of a Notice of Suspension or, where a hearingisrequested, thefmalactionoftheCommission sustaimng theSuspension underthis Section.

c. Duration

The Suspension shall be for the period stated m [Sctiedule U, wliere specified, or for such time as is ordered by the Airport Director not to exceed twelve (12) months, or until the violation no longer jeopardizes the health, safety or welfare ofthe traveling public.

d. AVlTaeDeactivation

Uponthecommencement ofa Suspension,(heCommissionmaydeactivatefheAVITag(s) for theServiceCompany,Owner'saffectedVehicle(s)and/ortheDriver'sLicenseforthelengthof the Suspension.

12.7 Revocations

  1. Conduct

    ServiceCompanyAuthorizations,TaxicabPermitsandMAC Driver'sLicensesmaybe revoked where any one ofthe following exist:

    1. (1)  A violations) for which a violator has had a previous Suspension within twelve (12) months prior to the violation.

    2. (2)  Violations for which Revocation is specified in Schedule D or Schedule HI.

    3. (3)  Violations that indicate a willful or reckless disregard for, and which has an immediate impactonthehealth, safetyorwelfare ofthepublic, othertaxicabDrivers, or MAC Representatives.

  2. Notice ofRevocation

    TheAirportDirectorshallhavetheauthoritytoissueaNoticeofRevocation.TheNoticeof Revocation shall set forth:

(1) thenature oftheviolation(s) which isthereason fortheRevocation; (2) thedateoftheviolation(s);

  1. (5)  thedateoftheNoticeofSuspension; and

  2. (6)  the right to a hearing.

MAC Driver's License

After a MAC Driver's License has been revoked, the Driver shall not be eligible to

applyforanotherMACDriver'sLicensefora periodoftwo(2)yearsfromthedate Revocationcommences.

Taxicab Permit

Intheeventthatanyorall oftheTaxicabPermitsofanOwnerarerevoked,the OwnershallbeeligibletoapplyforTaxicabPermitsasfollows:

  1. (i)  IntheeventthatfewerthanallTaricabPemutsofanOwnerarerevoked, for a periodoftwo(2)yearsafterthedateonwhichfheRevocationcommences, the total number ofTaxicab Permits which the Owner is eligible to hold shall bethenumberofTaxicabPermitsheldpriortotheRevocationminusthe numberofTaxicabPermitsrevoked.

  2. (ii)  IntheeventthatallTaxicabPermitsofanOwnerarerevoked, suchOwner shallnotbegrantedanyTaxicabPermitforanyVehiclefora periodoftwo (2) years from the date on which the Revocation commences.

Service Company

In (he event that a Service Company's Authorization hasbeenrevoked, the Service Company shallnotbeeligibletoapplyforAuthorization fromtheCommission for a periodoftwo(2)yearsfromthedateRevocationcommences.

d. Multiple Taxicab Permits

WhereanOwnerhasmorethanoneTaxicabPermit, onlytheTaxicabPermitfortheVehicle involvedintheviolationshallberevoked.Iftheviolation(s)givingrisetotheRevocation involves conductorpoliciesinvolving all oftheVehiclesoftheOwner,all ofhis/herTaxicab

Permitsshallberevoked.ConductorpoUciesinvolvmgallofanOwner'sVehiclesincludes but is not limited to:

  1. (1)  violationswhichhavethepotentialtoplaceinimminentjeopardythesafetyandwell- beingofothers; or

  2. (2)  violations involvmg dishonesty, fraud or corruption; or

  3. (3)  morethantwo(2)violations foroperatinganOwner'sVehicleswithoutaMAC Driver's License and where one-third or more ofthe Owner's Vehicles have been

    operated by Drivers who do not hold valid MAC Driver's Licenses during anytwelve (12) month period; or

  4. (4)  morethantwo(2)insuranceviolationsandwhereone-thirdormoreoftheOwner's Vehicles havebeen operated without the insurance required by this Ordinance during any twelve (12) month period.

Hearine Procedure

  1. TheprocedureshereinshallapplytoPersonsreceivinga NoticeofAssessment, Suspensionor Revocation ("Notice"), but shall not apply to an Immediate Dismissal From the Permitted TaxicabLanes,Delayed SuspensionRepairNotice or Orderfor Immediate Suspension.

  2. Any Person receiving a Notice of Assessment, Suspeusion or Revocation may request a hearingbeforeaHearingOfficer. Suchrequestmustbemadeinwritingandreceivedbythe AirportDirectorwithintwenty-one (21)calendardaysafterfheNoticeofAssessment, Suspensionor Revocationhasbeenissued.

c. IfthePersonrequestsahearing,theHearingOfficershallsetatimeforsuchhearingtobe held as soon aspractical. The Airport Director or designee shall notify the Owner or Driver of thetimeandplaceofthehearingnotlessthanseven(7)caleudardaysbeforethetimesetfor the hearing.

d. ThehearingshallbeconductedbytheHearingOfficer, shallberecordedbyelectrical or mechanicalrecorderorbya qualifiedreporter, andshallproceedasfollows:

  1. (1)  The Airport Director shall present evideucewhich supports the facts constituting grounds for fheNotice.

  2. (2)  ThePersonrequesting thehearingmayappearinperson, mayberepresented by counsel, may cross-examme Airport Director's witnesses who are present, and may presentanyrelevantevideucewhichtheOwnerorDriverhasrelatingtothefacts constitutinggroundsfortheNotice.Theevidenceatthehearingshallbelimitedto that which is relevant to the facts constituting grounds for the Notice.

  3. (3)  Alltestimony shallbetakenunderoath,butbothfheAiiportDirectorandthePerson requestingthehearingmayintroducetestimonyunderoathinthefonnofsworn statements ifwitnesses areunavailable orrefuseto appearm person.

  3. (6)  EithertheAirport Director orthePersonrequesting thehearingmayrequest review of theHearingOfBcer'sreport bytheExecutiveDirector/CEO. Thereviewmustbe requestedbyfilingwithfheExecutiveDirector/CEOa writtenRequestforReview withinten(10)daysofthedateoftheHearingOfficer'sreport.TheRequestfor Review must state reasons for reversing or vacating the report. The party not requestingreviewmaysubmita writtenResponsetotheRequestforReviewwithin ten(10) daysofthedateoftheRequestforReview.Basedontherecordofthe hearing,theRequest forReviewandtheResponse,theExecutiveDirector/CEOshall issueawrittenrulingthataffirms,reversesorvacatestheHearingOfGcersreport. TheExecutiveDirector/CEO mayorderremandtoaHearingOfGcerforanew hearing, a supplemental hearing and/or for additional fmdings.

Permit

AnyPersonviolatinganyoftheprovisionsofthisOrdinanceshalluponconvictionbepunishedby sentencewithintheparameters ofthemaximumpenaltyformisdemeanors setforthinMimi. Stat. § 609. 03 or as amended.

Provisions Severable

IfanypartofthisOrdinanceshallbeheldunconstitutionalorinvalid,thisdoesnotaffectthevalidityof theremainingpartsofthisOrdinance. TheCommission declaresitwouldhavepassedtheremamingparts ofthis Ordinance without the unenforceable provisions.

Repealer
As ofthe effective dates ofthis Ordinance, Ordinance No. 123 is repealed.
